Summary of the Middlebury Burn Ordinance

PERMIT ALWAYS REQUIRED
NO BURNING IN THE SUMMER MONTHS

Burning is allowed from November 1st, through the third Sunday of April between the hours of 8:00 a.m. and 4:00 p.m.

  • The fire must be attended to at all times until extinguished.

  • You are allowed to burn brush, garden waste, and untreated wood only.

  • You are not allowed to burn treated or painted wood or any type of plywood or laminated wood, plastics, hazardous materials, rubbish/trash, or large trees or stumps.

  • You must have a permit issued the day of the burn, because of variable weather conditions or state fire warnings no permits will be issued ahead of time. If you need to burn another day, you must get a new permit.

In evaluating whether or not an open burning permit is permitted, the fire warden or his assistant considers:

​

  1. Potential hazardous conditions (wind, dryness, etc.)

  2. The emission of air contaminants, which have the potential of creating a nuisance and/or danger to the health and property of the citizens.

  3. The proximity of any structure in relation to where the burning will take place

  4. Availability of Resource Park or disposal alternatives. The Addison County Transfer Station Route 7 South Middlebury will take brush untreated wood leaves and yard waste.

ORDINANCE IS SUBJECT TO A $1000 FINE AND COST TO EXTINGUISH THE FIRE BY THE FIRE DEPARTMENT
